We strive to ensure each customer is confident in the product(s) they are purchasing are an excellent match
with their unique property. We also strive to be transparent in our pricing, product availability, and all costs
associated with the purchase by providing customers with sales proposals prior to making a financial
commitment, if they prefer. Our commitment to customer service includes ensuring the following important
details are understood during the sales process.

Index to Terms and Conditions of Sale:

The cost of the sale is that shown on the Order Acknowledgement, unless a pricing error occurs, and is due at the conclusion of this Agreement. For the purposes of this payment, you will be redirected to an external Credit Card transactional platform. You will be subject to the terms and conditions of use of this external transactional platform.

The fees related to the handling and delivery of your Order, if applicable, are those indicated in the Order Acknowledgement (including applicable taxes) and no other fees will be charged.

While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered, we will inform you as soon as possible and give you the option of reconfirming your Order at the correct price or cancelling it. If we are unable to contact you after five (5) business days, we will treat the Order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

Acceptance of your Order and the completion of the Agreement between you and us will take place via Email confirmation, followed by shipment of the goods ordered unless we have notified you that we do not accept your Order, or you have cancelled it.

All prices are subject to change without notice. Feel free to call, fax, email or write to our sales personnel for current pricing information. All prices are FCA (Free Carrier) FIRE PUMP PACKAGE’s warehouse/shipping point unless specifically quoted otherwise.

Subject to the general and specific terms and conditions, FIRE PUMP PACKAGES (“Seller”) warrants to the Purchaser that its products, including any fire pump packages or component equipment will be free of defects in material and workmanship for the applicable Warranty Period and Coverage are defined below.

Two (2) years from date of shipment of Product to original Purchaser on the Engine and Pump.

Repair or replacement of Product that Seller determines failed during Warranty period due to a defect in material or workmanship. Seller offers no warranty with respect to engines or pumps, more than warranty provided by the original manufacturer MultiQuip (Pump) and Honda (Engine).

Engine Powered CET Fire Pumps

Two (2) years from date of shipment of Product to original Purchaser on the Engine and Pump.

Repair or replacement of Product that Seller determines failed during Warranty period due to a defect in material or workmanship. Seller offers no warranty with respect to engines or pumps, more than warranty provided by the original manufacturer CET Fire Pump (Pump), Honda (Engine), or Briggs and Stratton (Engine).

Engine Powered Davey Fire Pumps

Two (2) years from date of shipment of Product to original Purchaser on the Engine;

One (1) year on the Pump.

Repair or replacement of Product that Seller determines failed during Warranty period due to a defect in material or workmanship. Seller offers no warranty with respect to engines or pumps, more than warranty provided by the original manufacturer Davey Fire Pump (Pump), Honda (Engine), or Briggs and Stratton (Engine).

Thermo Gel Concentrate and Homeowners Kit

Three (3) years from date of shipment of Product to original Purchaser

Repair or replacement of Product that Seller determines failed during the Warranty period due to a defect in material or workmanship, contingent upon the Purchaser’s maintenance of the gel per Thermo Technologies instructions.

Scotty Fire Gel and Foam Sprayers

Two (2) years from date of shipment of Product to original Purchaser

Repair or replacement of Product that Seller determines failed during the Warranty period due to a defect in material or workmanship.

Key Fire and Rawhide Fire Hoses

One (1) year from date of shipment of Product to original Purchaser

Repair or replacement of Product that Seller determines failed during the Warranty period due to a defect in material or workmanship.

a) When products are combined to form a module or package, each Product will have its own separate Warranty Period and Warranty Coverage.

b) For each Product, Seller will have the option to refund to Purchaser (in cash or by credit) the purchase price that Seller was paid for such Product, less depreciation determined on a straight-line basis over the Warranty Period, in lieu of repair or replacement (including, when applicable, labor). The decision whether to repair, replace or refund (and, if there is a refund, whether to refund in cash or by credit) shall be made by Seller in its sole discretion.

The following limitations, exclusions, procedures and other terms and conditions shall apply for all Products:

The Warranty shall be voided upon the occurrence of any of the following events:

  • The Product is used for an application, with products or in a manner other than the application, products, and manner for which such Product is designed and intended;
  • The Product is subjected to a use, service, condition, or environment other than a use, service, condition, or environment for which such Product is designed and intended;
  • The Product is not properly installed by the Purchaser or its agent or representative;
  • The Product is not properly tested and maintained in accordance with Seller’s product manuals and supplemental instructions and guidelines as set out in full at www.waterax.com/en/warranty, applicable industry standards and guidelines, and applicable legal and regulatory requirements;
  • The Product is altered, modified, serviced (except for routine maintenance performed in accordance with the Seller’s product manuals and supplemental instructions, and industry accepted standards and guidelines), or repaired by a person other than the Seller or a person authorized by the Seller to make such alteration or modification or perform such service or repair;
  • The Seller is not paid the full amount of the purchase price for the Product when due;
  • The Purchaser undertakes to rent the Product to a third party in the context of a for-profit business.
  • Any bad faith invocation of a warranty claim or breach of a purchase agreement by the Purchaser.

The following are excluded from Warranty coverage:

  • Non-defective parts worn, exhausted or consumed through normal usage of the Product;
  • Any consumable parts normally subject to routine replacement, including but not limited to pump packing, O-rings, gaskets, intake screens, anodes, or filters;
  • Routine maintenance as specified and in accordance with the Seller’s product manuals and supplemental instructions and guidelines as set out in full at www.waterax.com/en/warranty
  • Failure due to compliance with a specification or design provided or required by Purchaser;
  • Failure due to improper operation, excess pressure, excess voltage, abuse, misuse, negligence or accidents or other similar causes;
  • Failure due to operator error;
  • Damage during or after shipment and failure attributable thereto or resulting there from;
  • Failure attributable to or resulting from the failure or substandard, inadequate, or improper performance of any part, component or equipment not supplied by the Seller.

Contact FIRE PUMP PACKAGES customer service at 1-800-797-1310 and one of our representatives will assign a Return Goods Authorization (RGA). Your “RGA” is required for ALL returns and will serve as a tracking number. A 25% re-stocking charge may apply.

Returned Goods will not be accepted without a valid RGA number. Material returned for reasons other than defective replacement will carry a handling and restocking charge of 25% of the invoice price of such merchandise may apply. Material must be in new and original condition subject to inspection and returned freight prepaid.

FIRE PUMP PACKAGES LLC (“SELLER”) WARRANTY AS SET FORTH HEREIN IS, TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE SELLER’S SOLE AND EXCLUSIVE WARRANTY AND IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ALL WARRANTIES OF MERCHANTABILITY, QUALITY, COURSE OF DEALING, USAGE OF TRADE, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

THE RIGHTS AND REMEDIES SET FORTH HEREIN ARE THE SOLE AND EXCLUSIVE RIGHTS AND REMEDIES AGAINST THE SELLER, EXCEPT FOR THE SPECIFIC LIABILITIES AND OBLIGATIONS PROVIDED HEREIN. THE SELLER SHALL HAVE NO LIABILITY OR OBLIGATION WITH RESPECT TO ANY PRODUCT CLAIMED TO BE DEFECTIVE IN ANY MANNER. THE SELLER SHALL NOT BE HELD LIABLE UNDER ANY CIRCUMSTANCES FOR ANY SPECIFIC, INCIDENTAL, INDIRECT, SUBSEQUENT OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST OR UNREALIZED SALES, REVENUES, PROFITS, COST OR BUSINESS SAVINGS, OR CONTRACTS, LOSS OF GOODWILL, DAMAGE TO REPUTATION, LOSS OF PROPERTY, DAMAGE TO REAL OR PERSONAL PROPERTY CAUSED BY WATER OR FIRE, LOSS OF INFORMATION OR DATA, LOSS OF PRODUCTION, DOWNTIME, OR INCREASED COSTS RELATED TO ANY PRODUCT, EVEN IF THE SELLER IS OR WAS NOTIFIED OF THE POSSIBILITY OF SUCH DAMAGE AND NOTWITHSTANDING THE FAILURE OF ANY ESSENTIAL FUNCTION OF ANY PRODUCT.

IN NO EVENT SHALL THE SELLER’S LIABILITY FOR ANY CLAIM UNDER THIS WARRANTY, INCLUDING FOR BREACH OF WARRANTY OR ANY CAUSE OF ACTION IN CONNECTION WITH AN ALLEGED BREACH OF THIS WARRANTY, EXCEED THE BUYER’S PURCHASE PRICE FOR THE PRODUCTS COVERED BY THIS WARRANTY.

Our Privacy Policy

“Personal information” is information, recorded in any form, about an identified individual or an individual whose identity may be inferred or determined from such information. “Personal information” does not include business contact information, except for business email addresses.

This Policy does not cover aggregated data from which the identity of an individual cannot be determined. FIRE PUMP PACKAGES reserves the right to use aggregated data in any way that it determines appropriate.

FIRE PUMP PACKAGES may collect your personal information when you:

While visiting the FIRE PUMP PACKAGES Web site, consumers may be asked to provide the following information about themselves to obtain more information about our products or services: email address; first and last name, nature of primary business (e.g., municipal department, equipment manufacturer, dealer/distributor, e-commerce retailer or other), company name and street address. In addition, you may voluntarily provide the complete address of your company.

 

  • Call FIRE PUMP PACKAGES. When consumers call FIRE PUMP PACKAGES, we might ask for their names, address, phone number, and other consumer profile information that helps us better serve their needs in the future. This information helps facilitate communication with our consumers by allowing us to identify the consumer quickly and efficiently.

 

  • Email FIRE PUMP PACKAGES requesting Consultation, Pricing, and Product information. If the consultation includes viewing the consumer’s property using GoogleEarth, FIRE PUMP PACKAGES will identify how the property address will be used for the purpose of providing recommendations intended to assist the consumer in selecting products to purchase.
  • Requesting to be added to FIRE PUMP PACKAGES periodic newsletter, as offered through our website or other communications with the consumer.
